According to the governor's office, E-cigarette flavors such as mint chocolate, bubblegum, cotton candy and cherry cola create a deceptive belief that they are not harmful. Data from California, Illinois, New Mexico, and Wisconsin indicate that the vast majority of these patients had vaped black-market THC products.

With respect to the recent illnesses reported as a result of vaping, patients using vape products reported a variety of symptoms, developing over a period of days to weeks, including: pulmonary symptoms (cough, shortness of breath, chest pain), gastrointestinal symptoms (nausea, vomiting, diarrhea), fatigue, fever, headache, and weight loss.

Notwithstanding the evidence from his own investigators, Cuomo seems to be deliberately muddling the issue.

Cuomo had this simple declaration: 'Vaping is unsafe'.

Cuomo was critical of the vaping industry's power over lawmakers in Washington, D.C. He said that "we're on our own" in terms of federal government action regarding guns, opioids, and vaping and said he believes vaping industry lobbyists are capable of stopping federal action because "their money can buy Washington". For smokers considering a switch to vaping, the relevant question is not whether e-cigarettes are "healthy" but whether they are less deadly that the conventional, combustible kind. And on that point there is no serious scientific dispute. The governor also signed legislation to expand current school-based programs and marketing campaigns aimed at reducing tobacco use to include e-cigarettes and liquid nicotine. That is unambiguously bad for public health.

"It is the tobacco cigarette model all over again", Cuomo said. "And many of these other products have no controls on them whatsoever, the so-called counterfeit products".
