Harvey Weinstein Sued by Jane Doe Over Alleged 2016 Rape

The complaint, filed Tuesday in L.A. County Superior Court by attorney Gloria Allred, claims Doe met Weinstein at a 2011 party at Chateau Marmont. The rep adds, "Mr. Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances".

Weinstein's representative Holly Baird says the producer can not speak to anonymous allegations but denies all allegations of non-consensual sex. She claims after the mogul learned she was an actress he offered to assist her with her career and asked for her phone number. "Mr. Weinstein obviously can't speak to anonymous allegations, but with respect to any women who have made allegations on the record, Mr. Weinstein believes that all of these relationships were consensual". For several years, Weinstein invited the woman to awards show parties.

Doe met with Weinstein at the Montage Hotel in Beverly Hills in late 2015 to discuss an acting opportunity on a television series and other projects. According to the suit, during the meeting Weinstein announced that he wanted to masturbate in front of her. She said she did not want him to do that.

She goes on to say in 2016 she met him again at the Montage to "celebrate her upcoming role in "Marco Polo".

During their meeting, the suit states that Weinstein excused himself and returned in a bathrobe.

The lawsuit alleges the company knew of Weinstein's sexual harassment and abuse behavior, and showed "deliberate indifference" to prevent his actions. She claims that he then pulled down her jeans and began to orally copulate her against her will. It's alleged that when she pushed him away, he used his "massive weight and strength" to hold her down and rape her. He then pulled out and held her down while masturbating with the other hand, according to the lawsuit.

The harassment and abuse allegations against Weinstein have created led to numerous women coming forward with allegations of harassment and abuse against powerful men, including actor Kevin Spacey, numerous entertainment industry executives and politicians in the United States and overseas.

She never received the part in "Marco Polo".

The lawsuit states claims of sexual battery, assault, and negligence, and seeks compensatory and punitive damages.
