Stalking case

A court in Chandigarh on Saturday sent Vikas Barala and his friend Ashish Kumar to judicial custody till August 25. Surya Prakash Garg, lawyer of the accused, said that his client has alleged that they are making him scapegoat in this case. The Chandigarh police had submitted an application asking for judicial remand for Barala, the son of Haryana Bharatiya Janata Party President Subhash Barala, and Kumar, for 14 days. Vikas and Ashish were presented in the court today following 2-day custody that expired on August 11. Regarding the incident, there was a huge outrage on the streets and in Parliament.

However, later on, the Chandigarh police allegedly invoked the IPC sections 365 and 511 against the accused and granted them bail without producing them in court. He told the court that "neither any kidnapping nor any molestation or any other offence was committed", adding that the case was "just a media trial".

Vikas and Ashish were earlier been arrested on August 5 on the complaint of the victim - daughter of an IAS officer, who had accused them of chasing her vehicle and trying to kidnap her.

Sources say that the police pressed for custody as they will require both the accused to conduct further investigation in relation to the complaint made by the victim.

A notice was issued to both the accused under 160 Code of Criminal Procedure (CrPC) and the case has been filed under Section 354D (stalking), 341 (wrongful restraint), 34 (common intention) of the Indian Penal Code (IPC) and 185 MV Act (driving by a drunken person or by a person under the influence of drugs). He assured action against his son.
