Fox News host Chris Wallace and Jay Sekulow, a member of President Trump's legal team, went head to head Sunday over whether the president is under investigation by special counsel Robert Mueller. So the Department of Justice recommended the removal of James Comey. "Witch Hunt." Pressed by TV interviewers, Sekulow declared that Trump was not being investigated, then tried to walk that back, at least slightly, saying there had been no such notification. The White House used a memo he wrote to justify Trump's decision to fire Comey, but Trump's firing of the Federal Bureau of Investigation director may now be part of the probe.

You have to wonder just what "anonymous sources" the Washington Post relied on to publish this bit of fake news. The department said last month that under professional responsibility rules, Mueller may participate in matters involving his former firm's clients as long as he wasn't involved in representing them and has no confidential information about them.

"That means there should exist on some server somewhere in the White House, a very thorough record of the kind of phone calls that nay investigator of the Trump campaign and the Trump White House's ties to Russian Federation any obstruction of justice regarding the investigation of those ties, should be able to access", Perlstein said. "When I have been crystal clear that the president is not and has not been under investigation".

The White House has been given until Friday by the House Intelligence Committee to provide an answer as to whether the recordings actually exist. They were obviously not in the know which suggests that either someone fed the Post disinformation or the newspaper didn't care if its report was accurate.

Though several Trump associates have hired more conventional attorneys from the elite ranks of Washington-region litigators - son-in-law Jared Kushner has turned to Jamie Gorelick, a former deputy attorney general in the Clinton administration, and Vice President Mike Pence has retained veteran Richmond, Virginia, defense lawyer Richard Cullen - the Trump defense team has a decidedly different pedigree. Of course, as the professor points out, Rosenstein's recusal is not terribly pressing, since the appointment of a special counsel removed him from the investigation anyway.

Sekulow has publicly criticized Comey, whom Trump fired.

With Twitter, "the president has an ability to communicate with a broad sloth of people of 107 million", said Sekulow. "What's being said right now is that the special counsel is looking at everything, including the circumstances around Comey's firing".
